4th directive Bodies

The 4th Directive (with EEA relevance1 ) provides for the establishment of various bodies in each Member State, notably

 

    • the Compensation Body which is responsible for compensating the visiting victim in the four following situations:
      • no Claims Representative appointed;
      • no presentation of a reasoned reply within three months of the date when the visiting victim presented his/her claim for compensation to the insurer of the liable vehicle or its Claims Representative;
      • non identification of the vehicle responsible for the accident
      • non identification of the insurer of this vehicle within two months after the accident;

    • & the Information Centre which is responsible for:
      • For keeping a register containing relevant information for the country concerned for a period of 7 years (after the termination of the registration of the vehicle or of its insurance contract) such as
        • the registration number of the vehicle,
        • the number of its motor third party liability (MTPL) insurance policy,
        • insurance companies and their claims representatives
        • and if applicable, the list of vehicles exempt from MTPL cover & the details of the body covering those vehicles ;
      • Or for coordinating the compilation and dissemination of this sort of information; 
      • And for assisting entitled persons (victims, insurers, compensation bodies, guarantee funds,…) to have access to that kind of information.

The 4th Directive refers also to the Guarantee Fund which is the body established in each EEA Member State in accordance with the 2nd Directive (Directive 84/5/EEC of 30th December 1983) and which compensates in certain cases accidents caused by uninsured or unidentified vehicle.
